Terms of Service
Last Updated: September 26, 2026
Welcome to Izaak’s Happy Hens, a family-run backyard farm located in Tempe, Arizona. These Terms of Service (“Terms”) govern your use of IzaaksHappyHens.com, as well as purchases, reservations, preorders, and other transactions made with Izaak’s Happy Hens.
By accessing our website, placing an order, reserving an animal, scheduling a pickup, or purchasing a product from us, you agree to these Terms.
Please read them carefully before making a purchase.
1. About Izaak’s Happy Hens
Izaak’s Happy Hens offers a rotating selection of backyard poultry and farm-related products, which may include:
-
Started pullets
-
Chicks
-
Hens and breeding birds
-
Fertile hatching eggs
-
Feeders and poultry supplies
-
Farm and garden products
-
Other related merchandise
Availability varies by season, hatch dates, breed availability, health, development, and other circumstances associated with raising live animals.
We reserve the right to change available breeds, products, quantities, pricing, pickup dates, and product offerings at any time.
2. Customer Eligibility
You must be at least 18 years old or have the involvement and permission of a parent or legal guardian to place an order.
By purchasing poultry from us, you represent that you are legally permitted to own and keep poultry where you live.
Customers are responsible for researching and complying with all applicable city, county, HOA, zoning, animal ownership, flock-size, rooster, and other local regulations.
Izaak’s Happy Hens is not responsible for determining whether poultry ownership is permitted at a customer's residence.
3. Live Animal Purchases
Purchasing a live animal is different from purchasing an ordinary retail product.
We make every reasonable effort to provide healthy birds that are eating, drinking, active, and appropriate for sale at the time they leave our care.
Whenever possible, customers are encouraged to inspect their birds at pickup. We may also perform a visual health check before birds leave our property.
Once a live bird has been inspected, accepted by the customer, and leaves our care, responsibility for the bird's housing, transportation, temperature, food, water, biosecurity, integration, predator protection, and general care transfers to the customer.
Live animals may experience stress when changing environments. Changes in temperature, transportation, diet, housing, flock dynamics, disease exposure, predators, improper integration, or other environmental factors can affect their health after pickup.
Except where specifically stated in writing or required by law, Izaak’s Happy Hens does not guarantee the future health, lifespan, productivity, temperament, or survival of an animal after it leaves our care.
4. Started Pullets and Sexing
Birds sold as started pullets are believed to be female based on the information available to us, which may include hatchery sexing, breed characteristics, physical development, and our own observation.
Poultry sexing is not always 100% accurate, particularly at younger ages.
Unless a specific written sex guarantee or replacement policy is included with the product listing, we cannot guarantee that every bird sold as a pullet will ultimately mature as female.
Customers should contact us promptly if they believe a bird purchased as a pullet is developing as a cockerel so we can review the situation.
5. Age, Appearance and Breed Characteristics
Ages listed for live birds are approximate unless an exact hatch date is specifically provided.
Photos on our website and social media may be representative of the breed or variety and may not show the exact animal the customer receives.
Individual birds may vary in:
-
Feather color and pattern
-
Size
-
Comb development
-
Egg shade
-
Temperament
-
Growth rate
-
Mature appearance
-
Laying age
-
Egg production
Breed descriptions are provided as general educational guidance and should not be interpreted as guarantees regarding an individual bird.
6. Egg Color and Egg Production
Descriptions such as blue, green, olive, chocolate brown, cream, pink, or similar egg colors describe the expected range associated with a breed or genetic cross.
Actual egg color can vary between individual hens and may change somewhat throughout a laying cycle.
We do not guarantee an exact egg shade, egg size, number of eggs per year, age at first lay, or frequency of production.
Egg production is affected by many factors including age, genetics, daylight, heat, nutrition, molt, stress, illness, and environment.
7. Arizona Heat and Environmental Conditions
Many of our birds are raised outdoors and acclimated to Arizona conditions before leaving our farm.
This does not mean that any chicken is immune to extreme heat.
All poultry kept in Arizona require appropriate heat management, including access to deep shade, fresh cool water, airflow, ventilation, and appropriate monitoring during periods of extreme temperatures.
Once a bird leaves our care, the customer assumes responsibility for providing a safe and appropriate environment.
8. Vaccinations and Health Information
Vaccination status may vary between birds and batches.
Some chicks may arrive from hatcheries already vaccinated, while other birds may be unvaccinated.
When vaccination information is known, we make reasonable efforts to accurately communicate it in the product listing or to the customer.
Unless specifically stated, customers should not assume that a bird has received any particular vaccine.
No poultry operation can guarantee that an animal will never develop or carry an illness.
Customers are strongly encouraged to follow appropriate poultry biosecurity practices and quarantine new birds before introducing them to an existing flock.
9. Integrating Birds Into an Existing Flock
Introducing new birds to an established flock carries inherent risks.
Customers are responsible for safely quarantining and integrating new birds.
Izaak’s Happy Hens is not responsible for injuries, illness, bullying, death, disease transmission, or other problems that occur during or following flock integration after birds leave our care.
Educational information we provide about quarantine, health, integration, feeding, heat management, or poultry care is general guidance and is not veterinary advice.
10. Fertile Hatching Eggs
Fertile hatching eggs are sold as eggs collected from breeding groups where fertility is reasonably expected.
Fertility does not guarantee hatchability.
Many factors outside our control affect whether an egg develops or successfully hatches, including:
-
Incubator temperature
-
Humidity
-
Egg turning
-
Storage
-
Handling
-
Incubator accuracy
-
Power interruptions
-
Sanitation
-
Individual embryo development
-
Customer incubation practices
For these reasons, we cannot guarantee a particular hatch rate or number of chicks from fertile hatching eggs unless a specific written guarantee accompanies the order.
Once hatching eggs leave our possession, incubation results are the responsibility of the purchaser.
11. Preorders and Reservations
Many of our birds are offered through scheduled seasonal batches or preorders.
A preorder reserves birds from a particular expected batch and pickup period.
Because we work with live animals, exact availability can occasionally change because of hatchery availability, sexing errors, illness, mortality, weather, predators, developmental concerns, or circumstances outside our reasonable control.
If we are unable to provide a bird that was ordered, we may offer the customer an appropriate option such as:
-
A refund for the unavailable bird
-
A comparable substitute
-
Store credit
-
Transfer to a later available batch
The options available may depend on the circumstances and will be communicated directly to the affected customer.
A bird purchased for one designated batch or month may not automatically be transferred to a later batch. For example, birds purchased from a September batch cannot simply be scheduled for an October pickup unless Izaak’s Happy Hens specifically approves the change.
Separate batches should be purchased and scheduled separately unless otherwise agreed in writing.
12. Pickup Scheduling
Live bird orders are generally fulfilled through scheduled local pickup.
Customers are responsible for selecting an available pickup date and time and arriving during their scheduled window.
Please contact us as soon as possible if you cannot make your scheduled pickup.
Rescheduling is subject to availability and is not guaranteed.
Because live birds require continued feed, housing, care, and space, orders that are not picked up during the designated pickup period may be subject to cancellation, rescheduling restrictions, boarding or care fees if disclosed, or loss of the reservation.
We reserve the right to determine whether a missed pickup can reasonably be accommodated.
13. Safe Transportation
Customers are responsible for bringing an appropriate carrier or transport container unless another arrangement has been made.
Birds must be transported in a manner that provides reasonable ventilation, protection from weather, and adequate space.
Animals should never be left unattended in a hot vehicle.
Izaak’s Happy Hens reserves the right to delay or refuse the transfer of a live animal if we reasonably believe the proposed transportation conditions create an immediate safety risk to the animal.
14. Cancellations, Refunds and Store Credit
Because live animals and agricultural products involve limited inventory, ongoing care, and scheduled availability, cancellation and refund eligibility may vary by product.
Any product-specific cancellation or refund policy shown on the product page, checkout page, preorder announcement, invoice, or written communication is incorporated into these Terms.
Unless otherwise stated, completed purchases should not be considered refundable simply because a customer changes their mind.
However, if Izaak’s Happy Hens is unable to fulfill an order, we will provide an appropriate resolution, which may include a refund, replacement, substitution, transfer, or store credit.
Nothing in these Terms limits any rights that cannot legally be waived under applicable law.
15. Order Changes and Breed Substitutions
Requested order changes are subject to availability.
We cannot guarantee that breeds, colors, ages, or quantities will remain available after an order is placed.
We will not substitute a different breed for an ordered live bird without communicating with the customer unless the customer has previously authorized substitutions.
16. Pricing
All prices are listed in U.S. dollars.
Prices may change at any time based on breed, age, availability, feed costs, hatchery costs, genetics, demand, and other factors.
A later price change does not normally change the price of an order that has already been paid and confirmed.
Obvious typographical, technical, or pricing errors may be corrected. If an error materially affects an existing order, we will contact the customer before fulfilling it.
17. Payments
Customers agree to provide accurate and authorized payment information.
Orders are not considered confirmed until required payment has been successfully received.
We reserve the right to cancel or hold an order if payment is declined, reversed, disputed, suspected of fraud, or otherwise not successfully completed.
Customers agree to contact us first when reasonably possible if there is a concern with an order so we have an opportunity to address the issue before a payment dispute or chargeback is initiated.
18. Coupons, Credits and Promotions
Coupons, promotional codes, discounts, and store credits are subject to the conditions stated when they are issued.
Unless otherwise stated:
-
Coupons have no cash value.
-
Coupons cannot be redeemed for cash.
-
Discounts cannot be applied retroactively.
-
Promotions may be limited to certain products.
-
Promotions may have expiration dates.
-
Promotions may not be combined with other offers.
-
Store credits and coupons may be limited to future purchases.
Specific coupon terms displayed on the coupon or promotion control if they differ from these general Terms.
19. Website Product Information
We make reasonable efforts to ensure information on IzaaksHappyHens.com is accurate.
However, agricultural inventory can change quickly, and occasional typographical, photographic, inventory, pricing, or technical errors may occur.
We reserve the right to correct errors and update website content at any time.
An automated order confirmation does not require us to fulfill an order based on an obvious pricing or inventory error. If such an issue occurs, we will contact the affected customer and provide an appropriate resolution.

To the fullest extent permitted by applicable law, Izaak’s Happy Hens will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of our website, products, educational information, or live animals.
This includes, where legally permitted, losses arising from:

Integration injuries

Nothing in these Terms excludes liability that cannot legally be excluded or limited.
25. Indemnification
To the extent permitted by law, customers agree to be responsible for claims, losses, or damages resulting from their own unlawful conduct, misuse of our website or products, or failure to properly care for animals after taking possession.
26. Refusal or Cancellation of Service
We reserve the right, where permitted by law, to refuse or cancel an order when necessary because of:
-
Animal welfare concerns
-
Fraud or suspected fraud

Payment problems

Unsafe transportation conditions
-
Customer harassment or threatening behavior
-

-

29. Changes to These Terms
We may update these Terms periodically.
The current version and effective date will be posted on IzaaksHappyHens.com.
Changes generally apply prospectively. Orders already placed remain subject to the terms and product-specific policies applicable at the time of the transaction, except where a change is required by law.
30. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
To the extent permitted by law, disputes relating to these Terms or purchases from Izaak’s Happy Hens will be handled in the appropriate state or federal courts located in Maricopa County, Arizona.
31. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
